  • AI-powered voice assistant that answers inbound phone calls on behalf of contractor businesses
  • Automated lead capture (name, phone number, address, service details, urgency)
  • SMS/text message delivery of captured leads to the contractor
  • Transactional SMS confirmations to callers regarding their service request

Service details, pricing, and specific terms for contractor clients are outlined in individual service agreements.

3. Eligibility

You must be at least 18 years of age to use our Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

4. SMS/Text Messaging Terms

By providing your phone number through our website form or during a phone call handled by our AI system, and consenting to receive messages, you agree to the following. For details on how we handle your data, see our Privacy Policy.

Consent:

  • You consent to receive transactional SMS/text messages from The Callback System at the phone number you provide
  • Consent may be provided via our website form (with written disclosure) or verbally during an inbound phone call (with verbal disclosure)
  • Consent to receive text messages is not a condition of purchasing any service
  • Your consent applies only to messages from The Callback System related to your service request. We will not transfer or assign your consent to any other messaging program or entity.

Message Types & Frequency:

  • Messages are transactional only — confirming receipt of your service request, providing callback timing, and service-related updates
  • We do not send marketing, promotional, or recurring campaign messages
  • Typical frequency: 1-3 messages per service interaction

Costs:

  • Message and data rates may apply depending on your mobile carrier and plan
  • The Callback System does not charge for text messages, but your carrier may

Opt-Out:

  • You may opt out at any time by replying STOP, CANCEL, END, QUIT, or UNSUBSCRIBE to any message
  • After opting out, you will receive a single confirmation message and no further texts
  • To resume messages, reply START

Opt-In Confirmation:

  • After providing consent, you will receive a single confirmation message, for example: "The Callback System: Your service request was received. Msg frequency varies. Msg & data rates may apply. Reply HELP for help, STOP to cancel."

Carrier Information:

Compatible with major US carriers including AT&T, Verizon, T-Mobile, Sprint, and others. Carrier participation and availability may vary. T-Mobile is not liable for delayed or undelivered messages. Other carriers are also not liable for delayed or undelivered messages.

5. AI Disclosure

Our Service uses artificial intelligence technology to answer phone calls. When you call a business that uses The Callback System:

  • You are interacting with an AI voice assistant, not a human
  • Calls may be recorded and transcribed for service delivery and quality purposes
  • Information collected during the call is used solely to fulfill your service request and relay your details to the contractor

6. Website Use

When using our Website, you agree to:

  • Use the site only for lawful purposes
  • Not attempt to disrupt, compromise, or gain unauthorized access to the site or its systems
  • Not scrape, crawl, or automatically extract data from the site without permission
  • Provide accurate information when submitting forms

7. Intellectual Property

All content, branding, logos, software, and materials on this Website are owned by The Callback System and protected by applicable intellectual property laws. You may not copy, distribute, modify, or reproduce any materials without prior written permission.

8. Disclaimer of Warranties

Service-level guarantees for contractor clients are governed by individual service agreements, not these Terms.

9. Limitation of Liability

To the maximum extent permitted by law, The Callback System and its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Website or Service, including but not limited to loss of revenue, data, or business opportunities, regardless of the theory of liability.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us, if any, in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless The Callback System and its owners, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Dispute Resolution

Any dispute arising from these Terms or your use of the Service shall first be addressed through good-faith negotiation. If the dispute cannot be resolved informally within 30 days, either party may pursue resolution through binding arbitration administered under the rules of the American Arbitration Association (AAA) in Los Angeles County, California. Each party shall bear its own costs. You agree to waive any right to a jury trial or to participate in a class action.

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought in the state or federal courts located in Los Angeles County, California.
